Please Review This Notice Carefully
This notice describes how health information about you may be used and disclosed, how you can obtain access to this information, and your rights regarding your health information.
True Growth Therapy is committed to maintaining the privacy and security of your protected health information (“PHI”) in accordance with applicable federal and California law.
Your Rights
When it comes to your health information, you have certain rights. This section explains those rights and True Growth Therapy's responsibilities in helping you exercise them.
Get a Copy of Your Health Record
You may ask to see or obtain an electronic or paper copy of health information maintained about you that you have a right to access.
A copy or summary will generally be provided within the time required by applicable law. A reasonable, cost-based fee may be charged when permitted by law.
Certain information may be excluded from your right of access as permitted by law. For example, psychotherapy notes, as specifically defined by HIPAA and maintained separately from the medical record, generally are not subject to the same right of access.
Ask to Correct Your Health Record
If you believe health information maintained about you is incorrect or incomplete, you may ask that it be amended.
True Growth Therapy may deny certain requests as permitted by law. If a request is denied, you will be provided information about the denial and any rights you may have to submit a statement of disagreement.
Request Confidential Communications
You may ask True Growth Therapy to contact you in a particular way or at a particular location.
For example, you may request that communication occur through a particular telephone number or that mail be sent to a different address.
Reasonable requests will be accommodated.
Ask Us to Limit What We Use or Share
You may ask True Growth Therapy not to use or disclose certain health information for treatment, payment, or health care operations.
True Growth Therapy is generally not required to agree to all requested restrictions.
However, if you pay for a health care service completely out of pocket, you may ask that information about that service not be disclosed to your health plan for payment or health care operations. True Growth Therapy will honor that request when required by law unless disclosure is otherwise required by law.
Get a List of Certain Disclosures
You may request an accounting of certain disclosures of your health information made during the six years before your request.
The accounting will not include every disclosure. For example, certain disclosures for treatment, payment, or health care operations and disclosures that you specifically authorized may not be included.
One accounting within a 12-month period will be provided without charge. A reasonable, cost-based fee may apply to additional requests when permitted by law.
Get a Copy of This Notice
You may request a paper copy of this Notice of Privacy Practices at any time, even if you previously agreed to receive it electronically.
Choose Someone to Act for You
If you have given another person legal authority to act on your behalf, such as through a valid health care power of attorney, guardianship, or other legally recognized authority, that person may be able to exercise your privacy rights.
True Growth Therapy will verify that person's authority before taking action.
For minors, parents, legal guardians, and minors may have different rights to access or control health information depending on the circumstances and applicable California law.

True Growth Therapy will not retaliate against you for filing a privacy complaint.
Your Choices
For certain health information, you may tell True Growth Therapy your preferences regarding what is shared.
Depending on the circumstances and applicable law, you may have choices about sharing information with family members, close friends, caregivers, or other people involved in your care or payment for your care.
If you are unable to communicate your preference, information may be disclosed when permitted by law and when disclosure is determined to be in your best interest or necessary to address a serious and imminent threat to health or safety.
Written Authorization
True Growth Therapy will obtain your written authorization before using or disclosing your health information when authorization is required by law.
Written authorization is generally required for:
Most uses and disclosures of psychotherapy notes as specifically defined by HIPAA
Marketing purposes requiring authorization
Sale of protected health information
Other uses or disclosures requiring authorization under federal or California law
True Growth Therapy does not sell your protected health information.
If you provide written authorization, you generally may revoke that authorization in writing at any time. Revocation will not affect actions already taken in reliance on your authorization.
How We Typically Use and Disclose Your Health Information
Treatment
True Growth Therapy may use your health information to provide, coordinate, or manage your treatment.
When permitted by applicable law, information may also be shared with other health care professionals involved in your treatment.
Health Care Operations
Health information may be used or disclosed as necessary to operate the practice, maintain quality of care, perform administrative functions, conduct appropriate consultation, comply with professional obligations, and manage services.
When outside individuals or organizations perform services involving protected health information on behalf of True Growth Therapy, appropriate privacy protections will be used when required by law.
Payment
Health information may be used or disclosed as necessary to obtain payment for services.
This may include billing, payment processing, insurance reimbursement activities, or providing documentation when authorized or otherwise permitted by law.
Other Uses and Disclosures Permitted or Required by Law
True Growth Therapy may use or disclose health information without your authorization when permitted or required by applicable law.
Depending on the circumstances, these disclosures may include:
Public Health and Safety
Information may be disclosed for legally authorized public health activities or when necessary to prevent or lessen a serious and imminent threat to the health or safety of a person or the public, as permitted by law.
Abuse or Neglect
True Growth Therapy may be required by law to report suspected child abuse or neglect, elder or dependent-adult abuse or neglect, or other circumstances subject to mandatory reporting requirements.
Compliance With Law
Health information may be disclosed when required by federal or state law.
Health Oversight
Information may be disclosed to authorized health oversight agencies for activities permitted by law, including audits, investigations, inspections, licensing, and disciplinary activities.
Legal Proceedings
Health information may sometimes be disclosed in response to a valid court order, subpoena, or other lawful process when the requirements of applicable federal and California law have been satisfied.
Mental health records may receive additional protections, and the existence of a subpoena or request does not necessarily mean that records will automatically be released.
Law Enforcement
Limited information may be disclosed to law enforcement when specifically required or permitted by applicable law.
Workers' Compensation
Health information may be disclosed when authorized or required by workers' compensation laws or similar programs.
Coroners and Medical Examiners
Information may be disclosed to coroners, medical examiners, or other authorized persons when permitted or required by law.
Psychotherapy Notes
HIPAA provides additional protection to certain psychotherapy notes.
“Psychotherapy notes” has a specific legal meaning and generally refers to notes recorded by a mental health professional documenting or analyzing the contents of counseling conversations that are maintained separately from the remainder of the medical record.
Most uses or disclosures of psychotherapy notes require your written authorization, except in circumstances specifically permitted or required by law.
Psychotherapy notes are different from the clinical record used to document treatment, which may include information such as diagnosis, treatment plans, symptoms, progress, medications, session dates, and other information maintained as part of your health record.
Substance Use Disorder Records
Certain substance use disorder treatment records may receive additional confidentiality protections under federal law, including 42 CFR Part 2.
To the extent True Growth Therapy creates, receives, or maintains records subject to Part 2, those records will be used and disclosed in accordance with applicable Part 2 requirements.
Information protected by Part 2 may have additional restrictions regarding its use or disclosure in civil, criminal, administrative, or legislative proceedings against the individual.
California Confidentiality Protections
Mental health information may be protected by California privacy and confidentiality laws in addition to HIPAA.
When California law provides greater privacy protection than federal law, True Growth Therapy will follow the applicable requirements providing greater protection.
In general, mental health treatment information will not be disclosed without appropriate authorization unless disclosure is permitted or required by applicable law.
California law also provides specific rules concerning confidentiality, access to records, treatment of minors, mandatory reporting, legal proceedings, and other circumstances. The rules that apply may depend upon the particular situation.
Our Responsibilities
True Growth Therapy is required to:
Maintain the privacy and security of protected health information as required by law.
Follow the duties and privacy practices described in the Notice of Privacy Practices currently in effect.
Provide you with a copy of this notice.
Notify you as required by law if a breach occurs that may have compromised the privacy or security of your protected health information.
Refrain from using or disclosing your health information except as described in this notice, as authorized by you, or as otherwise permitted or required by law.
Honor your privacy rights as required by applicable federal and California law.
If you authorize True Growth Therapy in writing to use or disclose information, you may generally revoke that authorization in writing at any time. Revocation will not undo disclosures already made in reliance on your authorization.
Changes to This Notice
True Growth Therapy may change the terms of this Notice of Privacy Practices.
Changes may apply to health information already maintained by the practice as well as information received or created in the future.
If this notice is materially revised, the updated notice will be made available upon request and posted on the True Growth Therapy website and at the practice as required by law.
